SMART SHOPPER TERMS AND CONDITIONS

- Being a registered member of the Smart Shopper Program signifies your agreement to the below Terms and Conditions as accepted on registration. Pick n Pay Retailers Pty Ltd (“PnP”) reserves the right to alter or change these Terms and Conditions or to terminate it at any point without prior notification.
- In the event of termination, your Smart Shopper points will remain valid for 30 (thirty) days from the termination date. Cash rewards held on your customer account will not be affected.
- By providing your personal information to us, you agree to be bound by our Privacy Statement which forms part of our agreement with you.
- In the event you wish to exit from the of the Smart Shopper Program or mange your preferences, please contact our Smart Shopper Team by emailing customercare@pnp.co.za , logon to your Smart Shopper profile, or contacting the PnP Customer Care Line, at 0860 303030.
- Any abuse of or fraudulent activity using the PnP Smart Shopper card constitutes a criminal offence and PnP reserves the right to cancel such person’s membership and withhold all their Smart Shopper points. PnP will also inform the appropriate authorities in this regard.
- PnP does not issue Smart Shopper Cards to minors under the age of 18 (eighteen). PnP, its organisers, promoters, partners and agencies do not bear any responsibility or liability for any loss, damage, injury, accident, and death or asset damage howsoever arising from inclusion or participation in the Smart Shopper Program.
- PnP accepts no responsibility for the theft or loss of your Smart Shopper card and/or Smart Shopper points. It is your responsibility to ensure that you keep your Smart Shopper card and your online Smart Shopper profile’s username and password safe and secure.
- The Smart Shopper card is issued by and remains the property of the Pick n Pay Group or any of its subsidiary or associated companies, reserving the right to decline, issue and withdraw at any time.
- The Smart Shopper card is not transferable.
- For all lost, stolen or damaged Smart Shopper cards, contact your local Customer Service Manager for in-store assistance, or the PnP Customer Care Line, at 0860 303030.
- Only one Smart Shopper card (blue card), which is linked to a single Smart Shopper point’s account, may be active with the exception where a customer also has a linked Tyme Bank Smart Shopper card (yellow card). See clause 45 below for further details.
- The Smart Shopper card may be used as a: Loyalty card, PnP Wallet and Store card or to be used as a card to present for another linked service purchase ie: WebTicket.
- Smart Shopper points rand value and funds in the PnP Wallet attached to a lost/blocked/defaced card can be transferred to your new Smart Shopper card. If Smart Shopper points have been switched or donated before your Smart Shopper card is blocked, there is no recovery of those Smart Shopper points. If points rand value or funds in the attached PnP Wallet have been redeemed in-store before the Smart Shopper card is blocked, there is no recovery of those Smart Shopper points or funds. PnP cannot be held liable for these losses. See clause 30 and 31 for expired point conditions.
- There is a PnP Wallet pre-loaded on your Smart Shopper card. The PnP Wallet will be activated for all registered Smart Shopper cards when you do a top-up at a PnP till point. The PnP Wallet can be used as a valid tender on all products and services sold at PnP but may not be redeemed for cash and no credit balance will be given as cash. The maximum PnP Wallet balance at any time is limited to R5000 (five thousand rand). Please refer to PnP wallet Terms and Condition at www.pnp.co.za/money/financial-services/pnp-wallet
- Your Pick n Pay Smart Shopper card can be used as a Store card should you apply and be granted the credit facility. Please refer to Pick n Pay Store card Terms and Conditions at www.pnp.co.za/store-account-t&c
- To earn Smart Shopper points for transactions, you must present your Smart Shopper card to a PnP cashier at a point of sale (till) or make use of your linked PnP Mobile App to scan the QR code on the PED (payment terminal) for the transactions to be recorded. If no Smart Shopper card is presented prior to payment, Smart Shopper points will not be earned for the transaction.
- Smart Shopper points cannot be earned retrospectively for transactions that occurred where the Smart Shopper card was not presented. If you do not have your Smart Shopper card at hand, you will need to have the PnP Mobile App installed and updated to the latest version. Refer to clauses 39 and 40 below on availability statements of the PnP Mobile App. You will then be able to scan your virtual Smart Shopper card by selecting the “cardless swipe” icon on the PnP mobile app. You can then scan the QR code on the card payment device at the till, a notification via the PnP Mobile App indicate if the operation was successful. The virtual Smart Shopper card will enable the same functionality as swiping the physical Smart Shopper card.
- The “cardless swipe” functionality can only be used within the Republic of South Africa at all PnP stores.
- PnP reserves the right at any time to exempt certain products from earning Smart Shopper points or receiving discounts in its sole and absolute discretion.
- Smart Shopper points will be reflected on your Smart Shopper account within 5 (five) days of your purchase.
- Opportunities to earn extra Smart Shopper points will be given at PnP’s sole and absolute discretion.
- In the event of a dispute regarding the Smart Shopper Loyalty Program and the implementation or interpretation of these Terms and Conditions (including but not limited to the determination of Eligible Transactions), the decision of PnP shall be final and binding.
- In the event that the Smart Shopper Loyalty system is offline, you will not be able to redeem discounts however you will earn Smart Shopper points on any purchases made. In the event of a technical, system(s) or network failure as well as system upgrades, Smart Shopper point’s allocations and/or cash-off discounts will not be processed and/or issued retrospectively.
- Smart Shopper customers will not earn points, rewards or get discounts on: tobacco and tobacco related products, prescription pharmaceutical goods, baby formula (0-36 months), pre-paid airtime and data, PnP Gift Card and top up, PnP Wallet top-up, money transfer, third party services and payments which include, but are not limited to prepaid electricity, LOTTO, Hollywood Bets and 3rd party cards such as iTunes / Google Play / Uber / Netflix etc. USA Visa tokens, Axxess ADSL tokens, Hollard Insurance, U-Kash, SAA Cycle voucher, Austrian Visa tokens, Just Surf, Retail Bonds, all lottery tickets, transactions through SAA, bus tickets, Multichoice, traffic fines, Splashout Mall Cards and pension payment. Event tickets and travel tickets (flight and bus) via Webtickets and FlightSite are excluded and do allow for the earning of points.
- PnP have introduced the following daily limits on earning Smart Shopper points at bp:
- a) No Smart Shopper card may be swiped at participating bpP Service Stations more than 5 (five) times in a day.
- b) Smart Shopper points may be earned on a maximum of 200l (two hundred litres) per transaction.
- c) Smart Shopper points on fuel purchases may only be earned up to a maximum upper limit per card of 500l (five hundred litres) per day
OFFLINE SMART SHOPPER SYSTEM

RESTRICTIONS
- Upon having collected your first 500 (five-hundred) Smart Shopper points (subject to the 5 (five) day period mentioned in clause 21 above) and registered as a Smart Shopper, you will be able to spend your Smart Shopper points in-store to pay for transactions.
- PnP reserves the right to change the conversion value of Smart Shopper points at its discretion. PnP will notify you in advance if such a change should occur.
- Smart Shopper points can be switched to a redemption partner or be donated to a charity on any PnP digital channel, unless otherwise stated. Please refer to Smart Shopper Business Partners and 3rd parties section below for additional Terms and Conditions.
- Smart Shopper points will be valid for 12 (twelve) months.
- PnP reserves the right to close any Smart Shopper account that has been inactive (no Smart Shopper points earned, switched or donated) for a period of 36 (thirty six) consecutive months. Smart Shopper points and money attached to closed accounts will be forfeited.
- Smart Shopper points earned for transactions where goods are later returned will be deducted from your Smart Shopper points balance on your Smart Shopper account. Returns are subject to the PnP Returns Policy. Please refer to the PnP Returns Policy at: www.pnp.co.za/returns-policy
- The Smart Shopper Loyalty Program tailors its offers to meet a customer’s specific needs. To achieve tailored offers and facilitate the earning of certain benefits (such as the accrual of points) via PnP’s partners, customer information is collected (limited to facilitate the intended purpose) and analysed in accordance with our Privacy Statement.
- Discounts (personalised, cash-off or ticketing at till) are made available per the PnP emailers, the kiosk, the PnP online shop, the PnP Mobile App or at the bottom of your till slip. Discounts can be redeemed in-store once loaded onto you Smart Shopper account. Some discounts may also be automatically loaded onto your Smart Shopper card, which must be swiped at the PnP till together with the qualifying products to redeem the applicable discount. Any discounts not redeemed will be available for selection later, provided the discount is still valid. Discounts redeemed will reflect on your till slip.
- Discounts may be redeemed at any PnP store within The Republic of South Africa against a linked valid Smart Shopper card
- Discounts will only be valid prior to the expiry date indicated on the discounts.
- If you have been targeted for a promotion or participate in an in-store promotion that requires you to spend the minimum amount to receive a discount, you will only be eligible for the reward if the total value of qualifying benefits after discounts meets the minimum threshold required.
- PnP Digital Channels are defined as in-store PnP kiosks, the PnP website (www.pnp.co.za), PnP Online Clothing (www.picknpayclothing.co.za/) and the PnP Mobile App.
- PnP cannot guarantee that the PnP Digital Channels will be operational at all times.
- Smart Shopper points look-up, switching, donations and redemption is subject to the on-line availability of PnP Digital Channels.

- There are 3 (three) types of Pick n Pay business partners:
- PnP Redemption Partners are defined as any organisation with whom PnP has a formal agreement for Smart Shoppers to redeem Smart Shopper points or switch Smart Shopper points for a voucher.
- PnP Earning Partners are defined as any organisation with whom PnP has a formal agreement for Smart Shoppers to earn Smart Shopper points.
- PnP Redemption and Earning Partners are defined as any organisation that meets both definitions. Please visit our website (www.pnp.co.za/pnpstorefront/pnp/en/partners) to view our redemption and earning partners.
- PnP may share your Smart Shopper personal details or detailed purchase data with linked business partners where it is necessary for the operation of the Smart Shopper and/or a linked loyalty program such as earning or redeeming of points in accordance with your permission as detailed in our Privacy Statement as well as the relevant business partner’s Privacy Policy.
- Personal information may also be shared with our business partners to establish which customised offers you may be interested in. Where Smart Shopper information is passed onto these business partners, this data will usually be shared via an aggregator who will anonymise or de-identify the data to ensure no personally identifiable information can be extracted from it.
- Registration for certain partners may require you, as the Smart Shopper customer to contact them directly to provide them your personal details to complete registration for their loyalty program as well as maintain your personal information independently of Smart Shopper on an ongoing manner.
- Smart Shopper customers who are also customers of Tyme Bank and who have linked their Smart Shopper profile to their Tyme Bank profile will have a Tyme Bank debit card which is replicated as a Smart Shopper card and is linked to their Smart Shopper points account. Tyme Bank customers will earn bonus Smart Shopper points, at an additional 1 (one) point for every R2 (two rand) of qualifying spend. This requires that customers swipe their Tyme Bank debit card and not their Pick n Pay Smart Shopper card to earn these points on the portion of their basket that is paid with their Tyme Digital bank card. Customers cannot swipe both a Pick n Pay Smart Shopper card and a Tyme Digital debit card to earn points for the same transaction.
- Tyme Bank’s debit cards cannot be used as Store cards, and do not offer the PnP Wallet functionality. Tyme Bank’s customers with an existing Store card facility or Wallet linked to their Smart Shopper card should retain their Smart Shopper cards.

- As a TymeBank customer, you will earn bonus Smart Shopper points, at an additional 1 (one) point for every R2 (two rand) of qualifying spend. You must swipe your TymeBank debit card and not your Smart Shopper card to earn these points. Smart Shopper points will only be earned on the portion of your basket that is paid with the Tyme Digital bank card. You will not be allowed to swipe both your Smart Shopper card and the Tyme Digital debit card to earn points for the same transaction.
- As a TymeBank customer, you will earn 1 (one) Smart Shopper point for every R10 (ten rand) spent outside of a PnP store when paying with your TymeBank card.
- TymeBank issued Smart Shopper points will be awarded monthly, in the month following eligible transactions.
- Should a new customer who was not an existing Smart Shopper, sign up for a TymeBank account and opt in for Smart Shopper benefits, later collect their Smart Shopper card, the 2 (two) card profiles will be linked, and points earned into a single Smart Shopper points account.
- PnP reserves the right to change the conversion value of Smart Shopper points at its discretion. PnP will notify you in advance if such a change should occur. Smart Shopper points can be switched to a redemption partner on any PnP Digital Channel, unless otherwise stated.
- Smart Shopper points are earned by and awarded at a rate of 10 (ten) Smart Shopper points for every 1 (one) litre of fuel purchased from participating bp service stations (subject to the Smart Shopper Program Terms and Conditions). Please refer to clause 55 for additional Terms and Conditions.
- BP and PnP reserve the right to change the Smart Shopper points allocation offering from time to time. All changes shall become effective as from the date specified in such communication.

- Smart Shopper points may be earned on the purchase of fuel from a participating bp service station but may not be earned in respect of those exclusions mentioned under eligibility transaction criteria and transaction limits. It is your responsibility to register your Smart Shopper card.
- Bonus Smart Shopper points, including launch offers or interim offers, communicated through campaigns and promotions via the standard Smart Shopper communication channels or by bp directly, may be earned on the purchase of fuel at participating bp service stations from time to time.
- Smart Shopper points may not be earned or redeemed at bp Express Stores (not affiliated to PnP) but may be earned or redeemed at PnP Express stores located at bp service stations.
- No Smart Shopper points can be earned at a participating bp service station if you do not present your Smart Shopper card at the time of purchase.
- If you are unable to earn Smart Shopper points at the participating bp service station due to technical issues, and you have presented your Smart Shopper card in respect of an Eligible Transaction, you can contact the PnP Customer Care Line, providing your proof of purchase which includes fuel receipt, card number and the payment device receipt showing that the transaction failed due to technical reasons.
- Smart Shopper points earned on Eligible Transactions will be calculated by rounding down to the nearest whole litre of fuel purchased from a participating bp service station.
- Smart Shopper points will not be earned if you are a bp FuelMaster, FuelMaster Plus, Masana Fuel Card, Fuel Master Card and Masana Contracted Fleet Move customer and pay using one of these payment types when fuelling at participating bp service stations. As such, these are considered to be non-Eligible Transactions for the purposes of the earning Smart Shopper points under the Smart Shopper Loyalty Program.
- BP and PnP reserve the right to amend the list of Eligible Transactions accepted at bp service stations for the purposes of the earning and/or redeeming of Smart Shopper points under the Smart Shopper Loyalty Program.
- Points may not be earned on the bp Loyalty Program and the Smart Shopper Loyalty Program in the same transaction. Where both programs are available to you, as the customer, you must elect either one of the two programs on which to earn points for each transaction.
- PnP Store Accounts cannot be used to purchase fuel at participating BP service stations.
- As long as you have a minimum of amount of R20 or more you can redeem this amount against any fuel purchase at bp service stations.
- PnP reserves the right to change the conversion value of Smart Shopper points at its discretion. PnP will notify you in advance if such a change should occur. Smart Shopper points can be switched to a redemption partner on any PnP Digital Channel, unless otherwise stated.

- Donate your Smart Shopper points to your choice of pre-selected charity organisation or switch to a third-party Smart Shopper partners. The minimum you can donate is R5 (five rand).

- 3.2 Smart Shoppers who sign up to the Pick n Pay Baby Club are eligible for the following:
- 3.2.1 To receive 3x Smart Shopper points on selected Baby purchases in any Pick n Pay store (instore and on various online PnP channels);
- 3.2.2 To receive regular Baby product deals, which will change at regular intervals;
- 3.2.3 Exclusive competition offers only available for Baby Club members.
- 3.2.4 Access to content, advice and forums when applicable and relevant.
- 3.2.5 Other offers and discounts at the discretion of Pick n Pay.
- 3.3 In order to qualify as an entrant for this promotion:
- 3.3.1 the entrant must live in the Republic of South Africa;
- 3.3.2 the entrant must provide correct and full personal details, as required; and
- 3.3.3 the entrant must be 18 years old or older.
- 3.3.4 the entrant cannot be a juristic entity and must be an individual;
- 3.3.5 the entrant must be a registered Smart Shopper card holder;

- 3.4.2.1 By signing up for the Baby Club entrants consent to being sent direct marketing and other communications from Pick n Pay via email and SMS.
- 3.4.2.2 Entrants understand that it may take up to 48 hours for their Baby Club registration to be successful and Baby Club discounts to apply.
- 3.4.2.3 Entrants understand that should they opt out of Baby Club by contacting the PnP Customer Careline.

- 3.7.1 Data allocated will NOT be transferrable to another number, the data allocated can only be used on the number associated with the Openview Connect Dongle.
- 3.7.2 Data is only valid for seven days.
- 3.7.3 Data allocated will be once-off, if a customer recharge with R29, they will be allocated with free data once off valid for seven days, if the same customer recharges again with R29, they will not qualify for the data allocation again.
- 3.7.4 The data allocation will be applicable to the first 400 customers who purchase an Openview data dongle and recharge with a minimum of R29 airtime.
- 3.7.5 The data allocated as part of the competition with recharge criteria of R29 will be consumed first.
- 3.7.6 If a customer does not recharge with a minimum of R29 airtime, they will not qualify for the promotional data allocation.
- 3.7.7 The data will be allocated within 7 days of activating the dongle. Activation of the dongle means - Rica the supplied SIM card with the dongle.
- 3.8 Any personal data relating to Winners or Participants will be used solely in accordance with the Consumer Protection Act and POPI, as the case may be, and will not be disclosed to a third party without the Winner or the Participant’s prior consent.
- 3.9 In the event of a dispute between the Promoter and a Participant/Winner, the decision of the Promoter will be final and binding and no correspondence will be entered into. - 4 SELECTION OF WINNERS
- 4.1 Winners will be selected within four weeks of the competition closure date (this date is subject to change without notice).

- 4 SELECTION OF WINNERS
- 4.1 Winners will be selected within four weeks of the competition closure date, 17 August 2022 (this date is subject to change without notice).
- 4.2 Entrants to whom prizes will be awarded will be selected through a random draw.
- 4.3 Winners will be contacted via email or telephonically within four weeks of the competition closure date (this date is subject to change without notice). Pick n Pay and Nestlé (South Africa) (Proprietary) Limited, reserves the right to disqualify a winner if he/she does not respond to the email or telephone call within one week of winner selection and randomly select a replacement winner from the competition entries. In such circumstances, the replacement winner shall be contacted via email or telephonically by Pick n Pay as soon as reasonably practicable and shall be required to respond to Pick n Pay in the manner set out in such correspondence. If the replacement winner fails to respond to Pick n Pay as required, then the provisions of this clause shall apply to that new winner in the same way as if he/she were the original winner. If the selected winner does not have any contact details a redraw will need to take place immediately.
