SMART SHOPPER TERMS AND CONDITIONS

1 Pick n Pay reserves the right to alter or change operational conditions of the Smart Shopper card programme or to terminate it at any point. In the event of programme termination, Smart Shopper points will remain valid for 30 days. Cash rewards held on the customer account will not be affected.
2 In the event you wish to opt-out of the of the Smart Shopper programme, please email Pick n Pay at smartshopperaccount@pnp.co.za or contact Pay n Pay Pick n Pay Call Centre at 0800 11 22 88.
3 Any abuse whatsoever of the Pick n Pay Smart Shopper card by any person constitutes a criminal offence and Pick n Pay reserves the right to cancel such person’s membership and withhold all Smart Shopper points from her/his account. Incorrect or invalid cards or card numbers will not be awarded Smart Shopper points.
4 Being registered as a member of the Pick n Pay Smart Shopper programme irrevocably signifies your agreement to the above Terms and Conditions. Pick n Pay, its organisers, promoters, partners or agencies do not bear any responsibility or liability for any loss, damage, injury, accident, and death or asset damage howsoever arising from inclusion or participation in the Smart Shopper programme.
5 You are required to submit your valid South African ID (or for Non-South African Citizens Passport Number) to register, to switch your Smart Shopper points, to change your details or manage your Smart Shopper card and points. By providing Pick n Pay with your personal information, you give Pick n Pay permission to send you information regarding its Smart Shopper programme via telephone, email, post, mail and physical delivery.
The Pick n Pay Smart Shopper card is issued by and remains the property of the Pick n Pay Group or any of its subsidiary or associated companies. Pick n Pay reserves the right to decline, issue and withdraw the Smart Shopper card at any time.
6 By providing Pick n Pay with your personal information and by opting in to communications, you give Pick n Pay permission to send you information regarding its Smart Shopper programme via telephone, email, post, mail and physical delivery.
7 A valid cell phone number, and/or postal address, and/or email address will be required from each holder of a Pick n Pay Smart Shopper card for all communications. No communication will be sent to phone numbers, postal addresses or email addresses outside South Africa.
8 In the event you wish to opt-out of Smart Shopper communication, please contact Pay n Pay Call Centre at 0800 11 22 88 or change your communication preferences on the Pick n Pay digital channels. Pick n Pay will ensure that it is compliant to the Consumer Protection Act.
9 The Pick n Pay Smart Shopper card is issued by and remains the property of the Pick n Pay Group or any of its subsidiary or associated companies. Pick n Pay reserves the right to decline, issue, re-issue and withdraw the Smart Shopper card at any time.
10 The Pick n Pay Smart Shopper card is not transferable.
11 There is a Pick n Pay wallet (Wallet) pre-loaded on your Pick n Pay Smart Shopper card. The Wallet will be activated for all registered Smart Shopper cards when you do a top-up at a till point. The Wallet can be used as a valid tender on all products and services but may not be redeemed for cash and no credit balance will be given as cash.
The maximum Wallet balance at any time is limited to R5000.
12 Your Pick n Pay Smart Shopper card will be used as a Store card should you apply and be granted the facility. Please refer to Pick n Pay Store card Terms and Conditions on https://www.pnp.co.za/store-account-t&c
13 For all lost, stolen or defaced cards, contact your Customer Service Manager in-store for assistance, or the Pick n Pay Call Centre at 0800 11 22 88. You can instruct Pick n Pay to block/deactivate your lost, stolen or defaced card and request a new card.
Remember that it is your responsibility to safeguard your Smart Shopper username and password profile details and ensure that it is not divulged to anybody else. In the event of someone else using your username and password to make changes to your profile or transact on your behalf, you will be held responsible for the changes and the outcome thereof.
14 Users may only have one active Smart Shopper card, which is linked to one Smart Shopper point’s account. Users who have multiple Smart Shopper cards will be required, as of 13 July 2016, to select one active Smart Shopper card. All other Smart Shopper accounts will be de-activated and stored points on the associated cards will be transferred to the one selected active account. Users who do not select one Smart Shopper card by 13 July 2016 will have their stored points transferred onto their most recently used Smart Shopper point’s account. All other associated Smart Shopper cards will be de-activated.
15 Smart Shopper points and funds in the Wallet attached to the lost/blocked/defaced card can be transferred to your new card. If Smart Shopper points attached to the card have been switched or donated before the card is blocked, there can be no recovery of Smart Shopper point’s value. If the Wallet attached to the card have been redeemed in-store before the card is blocked, there can be no recovery of Smart Shopper point’s value or the funds in the Wallet. Pick n Pay cannot be held liable for loss of Smart Shopper points.
16 Smart Shopper customers who are also customers of Tyme Bank and who have linked their Smart Shopper profile to their Tyme Bank profile will have a Tyme Bank debit card which is replicated as a Smart Shopper card and is linked to their Smart Shopper points account. Tyme Bank’s debit cards cannot be used as Store cards, and do not offer Wallet functionality. Tyme Bank’s customers with an existing Store card facility or Wallet linked to their Pick n Pay Smart Shopper card should retain their Pick n Pay Smart Shopper cards. Tyme Bank customers will earn bonus Smart Shopper points, at an additional 1 point for every R2 of qualifying spend. This requires that customers swipe their Tyme Bank debit card and not their Pick n Pay Smart Shopper card to earn these points (see clause 18 below) on the portion of their basket that is paid with their Tyme Digital bank card. Customers cannot swipe both a Pick n Pay Smart Shopper card and a Tyme Digital debit card to earn points for the same transaction. In addition Tyme Bank customers will earn 1 Smart Shopper point for every R3 they spend outside of Pick n Pay when paying with their Tyme Bank card. Tyme issued Smart Shopper points will be awarded monthly in the month following eligible transactions.
Should a new customer who was not an existing Smart Shopper sign up for a Tyme Bank account and opt in for Smart Shopper benefits later collect a blue Smart Shopper card, the two card profiles will be linked and points earned into a single points account. Tyme Bank customers are also subject to Tyme Banks’s terms at www.tymedigital.com/T&Cs.
17 To earn Smart Shopper points for transactions, the customer must present their Pick n Pay Smart Shopper card at Pick n Pay points of sale in order for the transactions to be recorded. If no card is presented at point of sale before payment, Smart Shopper points will not be earned for the transaction. Furthermore it is not possible to earn Smart Shopper points retrospectively for transactions in the past where the Smart Shopper card has not been presented.
The customer must ensure that their Pick n Pay Smart Shopper card has been captured for all their online shopping transactions, in order to earn points for those transactions.
Smart Shopper points may be earned on the purchase of fuel by Smart Shopper customers in possession of a valid and physical Smart Shopper card but may not be earned in respect of those exclusions mentioned under eligibility transaction criteria and transaction limits. It is the responsibility of the card-holder to register his/her Smart Shopper card.
Should you require a Smart Shopper Card, you can obtain one from your nearest Pick and Pay store or participating BP service station, subject to availability.
Smart Shopper points are earned by, and awarded to, the Smart Shopper card holder at a rate of 10 (ten) Smart Shopper points for every 1 (one) litre of fuel purchased from participating BP service stations (subject to the Smart Shopper Programme Terms and Conditions).
Bonus Smart Shopper points, including launch offers or interim offers, communicated through campaigns and promotions via the standard Smart Shopper communication channels or by BP directly, may be earned on the purchase of fuel at participating BP service stations from time to time.
BP and Pick n Pay reserve the right to change the Smart Shopper points allocation offering to customers associated with this BP and Pick n Pay fuel offering from time to time. All changes shall become effective as from the date specified in such communication.
Smart Shopper points may not be earned or redeemed at BP Express Stores but may be earned or redeemed at Pick n Pay Express stores located at BP service stations.
Smart Shopper points may only be earned using a valid and physical Smart Shopper card at a participating BP service station. No BP forecourt employee may accept a Smart Shopper customer’s points, for any reason, even if the Smart Shopper customer offers to give the points to the employee.
A customer cannot earn Smart Shopper points at a participating BP service station if his/her Smart Shopper card is not presented at the time of purchase.
If you are unable to earn Smart Shopper points at the participating BP service station due to technical issues, and you have presented your Smart Shopper card in respect of an Eligible Transaction you can contact the Pick n Pay Call Centre and kindly provide your relevant proof of purchase which includes fuel receipt, card number and the payment device receipt showing that the transaction failed due to technical reasons.
18 For every whole South African R2 spent on point-eligible items, a Smart Shopper point will be earned. No Smart Shopper points are earned on Cent amounts. You will receive your Smart Shopper points within 5 days of a transaction.
Smart Shopper points earned on Eligible Transactions will be calculated by rounding down to the nearest whole litre of fuel purchased from a participating BP service station.
19 Smart Shoppers will not earn points, rewards or get discounts on fuel, tobacco and tobacco related products, PnP Gift card and top up, Wallet top-up, money transfer, prescription pharmaceutical goods, baby formula (0-36 months),third party services and payments which include, but are not limited to electricity, USA Visa tokens, Axxess ADSL tokens, Hollard Insurance, U-Kash, SAA Cycle voucher, Austrian Visa tokens, Just Surf, Retail Bonds, all lottery tickets, transactions through SAA, bus tickets, Multichoice, traffic fines, Splashout Mall Cards and pension payment. Pick n Pay reserves the right at any time to exempt certain products from earning Smart Shopper points or receiving discounts at its discretion.
Smart Shopper will not earn points if you are a BP FuelMaster, FuelMaster Plus, Masana Fuel Card, Fuel Master Card and Masana Contracted Fleet Move customer and paying using one of these payment types when fuelling at participating BP service stations. As such, these are considered to be non-Eligible Transactions for the purposes of the earning) of Smart Shopper points under the Pick n Pay Smart Shopper Loyalty Programme.
BP and Pick n Pay reserve the right to amend the list of Eligible Transactions accepted at BP service stations for the purposes of the earning and/or redeeming of Smart Shopper points under the Pick n Pay Programme.
Points may not be earned on the Avios Loyalty Programme and the Pick n Pay Smart Shopper Programme in the same transaction. Where both programmes are available to you, as the customer, you must elect either one of the two programmes on which to earn points for each transaction.
We have introduced the following daily limits on Smart Shopper points:
No Smart Shopper card may be swiped at participating BP Service Stations 5 (five) times or more in a day;
Points may be earned on a maximum of 200l (two hundred litres) per transaction;
Points on fuel purchases may only be earned up to a maximum upper limit per card of 500l (five hundred litres) per day.
In the event of a dispute regarding the Pick n Pay Programme and the implementation or interpretation of these terms and conditions (including but not limited to the determination of Eligible Transactions), the decision of BP and Pick n Pay shall be final and binding.
Pick and Pay store accounts cannot be used to purchase fuel at participating BP sites.
20 Smart Shopper points will be reflected on your Smart Shopper account within 5 days of your purchase.
21 Opportunities to earn extra Smart Shopper points will be given at Pick n Pay’s sole discretion.
22 Upon having collected your first 500 Smart Shopper points (subject to the 5 day period mentioned in point 15. above) you will be able to spend your points in-store to pay for transactions, donate your Smart Shopper points to your choice of pre-selected charity organisation or switch to third party Smart Shopper partners. You are not obliged to switch or donate Smart Shopper points upon gathering 500 Smart Shopper points. You can save as many as you wish. You can only donate in units of 100 Smart Shopper points.
23 Pick n Pay reserves the right to change the conversion value of Smart Shopper points at its discretion. Pick n Pay will notify their Smart Shopper customers in advance if such a change should occur.
24 Smart Shopper points can be switched to a redemption partner, or donated to a charity on any Pick n Pay digital channel, unless otherwise stated.
25 Smart Shopper points will be valid for 12 months. Points that were previously switched to rand before Points @ POS will still be valid for their initial 3 year period. Pick n Pay reserves the right to close any Smart Shopper account that has been inactive (no Smart Shopper points earned, switched or donated) for a period of 12 consecutive months. Smart Shopper points and money attached to closed accounts will be forfeited.
26 Smart Shopper points earned for transactions where goods are later returned will be deducted from your Smart Shopper points balance on your Smart Shopper account. Returns are subject to the Pick n Pay returns policy.
27 In the event of a technical, system(s) or network failure as well as system upgrades, Smart Shopper point’s allocations and/or cash-off vouchers will not be processed and/or issued retrospectively.
27 Customers are now able to pay for their groceries, data or electricity using their points at the till instead of switching points to cash on to card via the Mobile app or kiosk.
28 Previously switch cash on card will be returned to points however they will still carry the initial validity period of 3 years.
29 Any new points earned will only be valid for 12 months
30 Smart Shoppers that don’t have their cards at hand will need to have the Pick n Pay mobile app installed and updated and will then be able to scan their Smart Shopper card virtually by selecting the MY VIRTUAL CARD icon on the app. The customer will scan the QR code on the card payment device at the till and will get notified on the app if the scan was successful or not. Virtual Smart Shopper card swipes will enable the same functionality as swiping a physical Smart Shopper card.
31 Customers can use cardless swipe in all stores except Express stores;
32 Customers can use cardless swipe functionality only in the Republic of South Africa;
33 Vouchers or Cash off Discounts are available on weekly email, kiosk, Pick n Pay online shop, mobile app & the end of till slips
34 Vouchers or Cash off Discounts may be redeemed at any Pick n Pay store in South Africa.
35 Vouchers or Cash off Discounts may only be redeemed with the relevant Smart Shopper card.
36 Vouchers need to be selected at the in-store kiosk, on the Pick n Pay online shop and/or via the Mobi App and will be automatically loaded to the Smart Shopper card. The Smart Shopper card needs to be swiped at the till with the qualifying products to redeem the applicable voucher. Any vouchers not used will be loaded back to the in-store kiosk, the Pick n Pay online shop and/or the Mobi App and will be available for selection at a later date, provided the voucher is still valid.
37 A confirmation message will reflect on your till slip when a voucher has been redeemed.
38 The voucher will only be valid before the expiry date indicated on the voucher.
39 If a customer has been targeted for a promotion that requires them to spend the minimum amount to get a discount, a customer will only get the reward if the total value after discounts meets the minimum threshold required.
40 Where a customer participates in an in-store promotion that requires them to spend the minimum amount to get a discount, a customer will only get the reward if the total value after discounts meets the minimum threshold required.
41 Smart Shoppers will receive instant savings on selected products in Pick n Pay stores. These promotions will be available for limited periods from time to time. Please note that not all products are available in all stores and special offers may change without notice.
42 Pick n Pay may change any instant savings offers at any stage.
43 A confirmation message will reflect on your till slip when Instant Savings have been applied.
44 Instant savings will not be offered on the Pick n Pay online shop.
45 Pick n Pay Digital channels are defined as in-store kiosks, the Pick n Pay website (www.picknpay.co.za) and the mobile application.
46 Pick n Pay cannot guarantee that the digital channels will be operational at all times.
47 Smart Shopper points look-up, switching, donations and redemption is subject to on-line availability of Pick n Pay digital channels

48 Pick n Pay redemption partners are defined as any organisation with which Pick n Pay has an agreement, for Smart Shoppers to switch their Smart Shopper points, to the partner’s loyalty points.
49 Pick n Pay earning partners are defined as any organisation with which Pick n Pay has an agreement, for Smart Shoppers to switch their partner loyalty points to Smart Shopper points.

51 Registration for certain third party partners may require the Smart Shopper customer to contact the third party directly to complete the registration.
52 Upon having collected your first 500 Smart Shopper points (subject to the 5 days period mentioned in point 8. above) you will be able to switch your Smart Shopper points to any of the redemption partners. You are not obliged to switch or donate Smart Shopper points upon gathering 500 Smart Shopper points. You can save as many as you wish. You can only switch or donate in units of 100 Smart Shopper points.
53 Discovery card holders can enrol in the Pick n Pay Smart Shopper card programme and get benefits from both schemes. Presentation and swipe of both cards is required to get the benefits of both schemes.
54 Should you be part of a third party programme and your Smart Shopper card is lost / stolen or defaced you will be required to update your details with the third party directly to ensure you earn the points associated with that third party. This responsibility is not held by Pick n Pay. Any lost points relating to this will not be awarded in retrospect.
55 Pick n Pay will not share your details with any other company unless it is entirely necessary for the operation of the Smart Shopper and/or linked programmes. The Pick n Pay Smart Shopper programme does however tailor its offers to meet the customer’s specific needs. In order to achieve this as well as to facilitate the earning of certain benefits (such as the accrual of points) via Pick n Pay’s business partners, your details may be passed to such business partners. This information will be limited to only information required to facilitate an intended purpose. Where any detailed Smart Shopper data is passed onto Pick n Pay’s business partners, this data will shared via an aggregator who will anonymise the data to ensure no personally identifiable data can be extracted from it. The initial communication to this effect will always be initiated by Pick n Pay.
56 When you swipe your Smart Shopper card, you are agreeing to the Terms and Conditions stated above.

1 TERMS AND CONDITIONS

2.4 The entrant acknowledges that by signing up to this promotion he/she has been given an appropriate opportunity to first read these terms and conditions before joining and the he/she understands and agrees to the terms and conditions.
2.5 All entrants to this promotion participate entirely at their own risk. By reading and accepting these terms and conditions, the entrant gives consent to these risks and hereby indemnifies and holds harmless the promoters and Pick n Pay Stores Limited and all entities in the Pick n Pay group; their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the promotion and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any indemnified party.
3 RULES OF THE PROMOTION
3.1 This promotion opens on 25 June 2018 and is an ongoing promotion.
3.2 Smart Shoppers who sign up to the Pick n Pay Baby Club are eligible for the following:
3.2.1 To receive 3x Smart Shopper points on all Baby purchases in any Pick n Pay store;
3.2.2 To receive regular Baby product deals, which will change at regular intervals;
3.2.3 Exclusive competition offers only available for Baby Club members.
3.2.4 Access to content, advice and forums when applicable and relevant.
3.2.5 Other offers and discounts at the discretion of Pick n Pay.
3.3 In order to qualify as an entrant for this promotion:
3.3.1 the entrant must live in the Republic of South Africa;
3.3.2 the entrant must provide correct and full personal details, as required; and
3.3.3 the entrant must be 18 years old or older.
3.3.4 the entrant cannot be a juristic entity and must be an individual;
3.3.5 the entrant must be a registered Smart Shopper card holder;
3.3.6 the entrant is the legal guardian of the children/minors who are detailed as their children when signing up for participation in the Pick n Pay Baby Club scheme and the entrant is authorised to share these details with Pick n Pay for the purpose of administration of the Baby Club;
3.3.7 The promoters, Pick n Pay Retailers (Proprietary) Limited, any entity in the Pick n Pay Group or Company, their directors, members, partners, employees, agents or consultants, the suppliers of goods or services in connection with this promotional competition, or any other person who directly or indirectly controls or is controlled by the above named parties and their respective spouses, life partners, business partners or immediate family members are not permitted to participate in this promotional competition.
3.4 To enter the promotion, the entrant must:

3.4.2 Sign up to join the Pick n Pay Baby Club via the Pick n Pay website, www.picknpay.co.za/babyclub by including their Smart Shopper card number and personal details, including but not limited to, email address and mobile number or send a FREE SMS to short code 30651 or reply YES to a specific Baby Club SMS for which standard network rates apply.
3.4.2.1 Entrants will receive communication from Pick n Pay via email and SMS informing them of Baby Club special offers and competitions.
3.4.2.2 Entrants understand that it may take up to 5 working days for their Baby Club registration to be successful and Baby Club discounts to apply.
3.4.2.3 Entrants understand that should they opt out of Smart Shopper communications, they will continue to receive Baby Club communications unless they specifically opt out of Baby Club.

4 GENERAL
4.1 By entering the promotion in accordance with its terms, you are entering a promotion for the purposes of the Consumer Protection Act, 2008 ("CPA") and the promotion will be conducted in accordance with the relevant provisions of the CPA.

- 3.6 To enter the competition online, the entrant must purchase any 3 (three) Scotch-Brite products and link their smart shopper card details to their Pick n Pay online profile before check out for automatic entry.
- 3.7 Participants may enter the promotional competition as many times as they wish
- 4 SELECTION OF WINNERS
- 4.1 Winners will be selected within four weeks of the competition closure date (this date is subject to change without notice).
- 4.2 Entrants to whom prizes will be awarded will be selected through a random draw.
- 4.3 Winners will be contacted via email or telephonically within four weeks of the competition closure date (this date is subject to change without notice). Pick n Pay and 3M South Africa (Pty) Ltd reserve the right to disqualify a winner if he/she does not respond to the email or telephone call within one week of winner selection and randomly select a replacement winner from the competition entries. In such circumstances, the replacement winner shall be contacted via email or telephonically by Pick n Pay as soon as reasonably practicable and shall be required to respond to Pick n Pay in the manner set out in such correspondence. If the selected winner does not have any contact details a redraw will need to take place immediately.
- 4.4 Pick n Pay and 3M South Africa (Pty) Ltd reserve the right to amend the terms and conditions as well as terminate the Competition at any time. In the event of such termination, all participants agree to waive any rights that they may have in terms of the Competition and acknowledge that they will have no recourse against Pick n Pay, 3M South Africa (Pty) Ltd, its advertising agencies, advisors, suppliers and nominated agents.

- 4 SELECTION OF WINNERS
- 4.1 Winners will be selected within four weeks of the competition closure date (this date is subject to change without notice).
- 4.2 Entrants to whom prizes will be awarded will be selected through a random draw.
- 4.3 Winners will be contacted via email or telephonically within four weeks of the competition closure date (this date is subject to change without notice). Pick n Pay and Rhodes food group (Pty) Ltd reserves the right to disqualify a winner if he/she does not respond to the email or telephone call within one week of winner selection and randomly select a replacement winner from the competition entries. In such circumstances, the replacement winner shall be contacted via email or telephonically by Pick n Pay as soon as reasonably practicable and shall be required to respond to Pick n Pay in the manner set out in such correspondence. If the replacement winner fails to respond to Pick n Pay as required, then the provisions of this clause shall apply to that new winner in the same way as if he/she were the original winner. If the selected winner does not have any contact details a redraw will need to take place immediately.
- 4.4 Pick n Pay and Rhodes food group (Pty) Ltd reserve the right to amend the terms and conditions as well as terminate the Competition at any time. In the event of such termination, all participants agree to waive any rights that they may have in terms of the Competition and acknowledge that they will have no recourse against Pick n Pay, Rhodes food group (Pty) Ltd, its advertising agencies, advisors, suppliers, and nominated agents.
